Septic Systems in Northeast Texas: The Backyard You Cannot Always Use

What should I know before buying a home with a septic system in Texas? Find out which type it is, get the county permit and as-built drawing and understand that the disposal field restricts what you can build or plant in that part of the yard.

I recently worked my first property with a drip emitter system and I learned something that would have mattered a great deal to the right buyer.

They could not put in a pool. Not without completely reworking the system. And they were limited on what they could plant in their own backyard.

Nobody tells you that at a showing. The yard looks like a yard. There is grass, there is space and there is nothing visible that says a third of it is spoken for. But underneath, there is a grid of pressurized lines and emitters doing a job and that job comes first.

If you are moving from Sachse or Garland out to acreage around Lavon, Nevada, Copeville, Princeton or Royse City, this is the system you are inheriting and nobody is going to explain it to you. So here it is.

The systems you will actually run into

Texas calls these on-site sewage facilities and the state regulates them through TCEQ. There are more designs than most people realize but out here you will mostly see three.

Conventional anaerobic. A septic tank followed by a gravity drainfield. Solids settle in the tank, liquid flows out into buried trenches and the soil does the rest. No electricity, no moving parts to speak of, no pump. Simplest and cheapest to own but it needs the right soil and enough of it. This is what most people picture when they hear "septic."

Aerobic with spray irrigation. A tank, then an aerated chamber where air is pumped in to treat the wastewater more thoroughly, then chlorine disinfection, then a pump tank that sprays the treated effluent onto the yard through sprinkler heads. You will see the heads. Sometimes they run at dawn.

Aerobic with subsurface drip irrigation. Same treatment train, different disposal. Instead of spraying on top, the effluent goes into a grid of small pressurized lines buried at least six inches deep, with pressure-reducing emitters spaced no more than 30 inches apart. Nothing on the surface. This is the one I ran into and from the driveway it is invisible.

You will also occasionally find low pressure dosing, evapotranspiration beds, mound systems, and, rarely, a holding tank that simply gets pumped out. Those are worth a conversation of their own if you find one.

The part that changed how I show rural properties

Here is what I did not appreciate until I had a client standing in a backyard asking about a pool.

The disposal field is infrastructure and you cannot build on it. Not a pool, not a shop, not a detached garage, not a slab for an RV pad. A pool in particular is not a "move a line" problem. It is an excavation through the middle of a permitted disposal system and it means redesigning and re-permitting the whole thing, if the lot even has room for a redesign. Frequently it does not.

What you plant matters too. On a drip field, deep-rooted trees and large shrubs are a real problem because roots find emitters and clog them. That is the same reason you keep trees away from a conventional drainfield.

Spray systems have the opposite issue and it is just as constraining. The state requires the application area to be covered with vegetation, on terrain at 15 percent slope or less, with nothing within ten feet of a sprinkler that would interfere with uniform application and the rate adjusted so there is no runoff. So you cannot leave it bare, you cannot crowd the heads and you cannot pave it.

Either way, a meaningful piece of that backyard is committed. Before you fall in love with a property, ask where the field is and get it drawn on paper because the answer determines what your yard can ever become.

What the county requires

Texas sets the rules through TCEQ but permitting is handled locally by what the state calls an authorized agent, which around here means your county. If the property is in unincorporated Collin, Rockwall, Hunt, or Kaufman County, that county's environmental or development services office is who issues, inspects and keeps the file.

A few things that follow from that:

There should be a permit and there should be an as-built drawing. Ask for both. This is a public record and the county can produce it. A system with no permit on file is not a small paperwork issue. It means nobody inspected the installation and you have no documentation of what is buried out there or where.

Lot size minimums apply to newer subdivisions. Subdivisions platted after the rule took effect need at least half an acre per lot when served by a public water supply and at least a full acre when they are not. That is why rural lots are sized the way they are.

Aerobic systems require a maintenance contract with a licensed provider. This is not optional and it is not a service plan you can decline. The provider inspects the components, tests the system and files reports with both you and the permitting authority at least every four months. When the house sells, that contract needs to be transferred or replaced and the permit may need to be transferred into your name.

There is a disclosure form for this. If a seller answers yes to having an on-site sewer facility on the Seller's Disclosure Notice, they should be completing the Texas REALTORS form for on-site sewer facilities. It captures the system type, the approximate location of the field, the installer, the age, maintenance contract information, when it was last pumped and any known defects. Read it. And understand it is a disclosure, not an inspection and not a warranty.

The maintenance nobody explains

Some of this is genuinely surprising and one item is a safety issue.

Use the right chlorine tablets. This is the one I want people to actually remember. Wastewater chlorinators take calcium hypochlorite tablets. Swimming pool tablets are trichloroisocyanuric acid. They look nearly identical, the pool ones are cheaper and people buy them at the hardware store all the time. According to TCEQ, pool tablets in a chlorinator can release nitrogen chloride, an explosive gas because they are not fully immersed in water at all times. They also dissolve more slowly and do not disinfect properly. Never use them and never mix the two.

Skip the garbage disposal, or use it sparingly. A disposal does not make food waste disappear. It grinds it into solids that land in your tank, which fills faster and needs pumping sooner. TCEQ's own guidance to owners is about not burdening the system with an undesirable load of solids and a disposal is the most efficient way to do exactly that. Scrape plates into the trash and compost what you can.

Do not add anything to the tank. TCEQ specifically cautions against chemical additives and the so-called enzyme products sold as septic treatments, noting some may actually be harmful to the tank's operation. The bacteria are already there and doing the work. Do not sterilize them with volumes of bleach either.

Nothing goes down that is not human waste and toilet paper. Wipes are the biggest offender by far and the ones labeled flushable are the worst of them, which I got into in Are "Flushable" Wipes Wrecking Your Plumbing?. On a septic system the stakes are higher than a clogged line.

Watch your water. These systems are sized for a specific daily flow tied to the number of bedrooms. A leaking toilet, a long houseguest season, or doing six loads of laundry in one afternoon can push a system past what it was designed to handle. TCEQ suggests checking toilets for leaks with a dye test.

Know your alarms. Aerobic systems have them, usually for high water and air pump failure and an alarm is telling you something is wrong right now. It is not a nuisance light to be ignored until the next inspection.

Pump on schedule. A conventional tank generally needs pumping every three to five years, using a TCEQ registered sludge hauler and household size and tank capacity move that number.

Before you write the offer

  1. Ask what type it is and get the answer in writing, not "it's septic."
  2. Pull the permit and the as-built from the county. If neither exists, that is a real finding and it changes what you are buying.
  3. Get a separate septic inspection. Your general home inspector does not evaluate the septic system. This is its own specialist and its own fee, and it is the best money you will spend during the option period.
  4. Ask for the maintenance records. For an aerobic system, the last two years of provider reports tell you the truth about how it has been treated.
  5. Find out where the disposal field is and mark it on a plat, then decide what you want that yard to be. Pool, shop, garden, playset. Ask before you are emotionally committed.
  6. Confirm the contract and permit transfer. Know what has to happen at closing and who is doing it.
  7. Ask the age. These are not permanent. Replacement costs real money, and an aging system is a negotiating point.

None of this should scare you off rural property. Plenty of people out here have septic systems that work fine for decades and never think about them. But a septic system is a piece of equipment you now own and operate, and the difference between the people who are happy with theirs and the people who are miserable is almost entirely whether anyone explained it to them before they closed.

Frequently asked questions

Can you put a pool in a yard with a septic system? Sometimes, but not over the disposal field. On an aerobic drip or spray system the field occupies a large portion of the usable yard, and installing a pool would mean redesigning and re-permitting the disposal system, if the lot has room for an alternative at all. Ask where the field is before you plan a pool, not after.

Does a home inspector check the septic system? No. A standard Texas home inspection does not evaluate an on-site sewage facility. You need a separate inspection by someone qualified to evaluate septic systems, and you should order it early in your option period because scheduling in rural areas can take time.

What is the difference between an aerobic and a conventional septic system? A conventional system settles solids in a tank and lets a gravity drainfield handle the rest, with no power and no moving parts. An aerobic system adds air to treat wastewater more thoroughly, disinfects it, and then pumps it out through spray heads or buried drip emitters. Aerobic systems treat waste better but require electricity, more equipment, and a mandatory maintenance contract.
